Comunicado de Regra Final esperado para Novembro 2018

O escritório de Gestão e Orçamento do governo dos EUA publicou a sua Agenda Unificada de Ações Regulatórias e de Desregulamentação, que contém agendas atualizadas de dois regulamentos EB-5 já propostos e aviso prévio de um terceiro.
A regulação da maior preocupação é a RIN: 1615-AC07, “Modernização do programa de Investidor Imigrante EB-5”.

Este regulamento moveu-se agora para fase final e é esperada a sua publicação em Novembro 2018, tornando-se eficaz logo depois disso.

Significado da regra final da modernização do programa

Se feita “final” em novembro, a regra proposta poderia entrar em efeito no fim de 2018. As petições apresentadas antes da data efetiva da regra final deverão qualificar-se na política vigente (500,000 USD de investimento mínimo), mas uma vez que a regra final entrar em vigor, as petições estarão sujeitas a quaisquer alterações no programa EB-5.

Alterações antecipadas do programa feitas pela regra final

As mudanças exatas no Programa EB-5 feitas por esta regra não serão sabidas até que sua versão final esteja publicada, mas a regra, como redigida hoje, propõe as seguintes mudanças preliminares:

(1) um aumento do limite mínimo de investimento: de $1,000,000 para $1,800,000 para investimentos em áreas “comuns” e de $500,000 a $1,350,000 para investimentos em áreas rurais ou de baixo emprego (TEAs)

(2) uma mudança na autoridade de designação das áreas TEA: os Estados individuais deixam de ser responsáveis, passando para o Departamento de Segurança Interna

(3) uma definição refinada de “TEA” para incluir áreas estatísticas metropolitanas, municípios, cidades, setores censitários únicos e grupos limitados de setores censitários que apresentem altas taxas de desemprego.

(4) em determinadas circunstâncias, a permissão para os investidores com as petições I-526 aprovadas para manter as suas datas prioritárias ao enviar novas petições I-526.

(5) a capacidade de cônjuges e filhos de peticionários de enviarem petições I-829, mesmo que não são mencionados na petição original do investidor.

AÇÕES A TOMAR AGORA

PARA DONOS DE PROJETOS: agora o momento de montar a documentação do projeto, de obter o apoio de um regional do centro, e enviar as petições pendentes antes que tais mudanças potenciais entrem em efeito.

PARA OS INVESTIDORES: Uma vez que o requisito mínimo de capital deve aumentar substancialmente, agora é o momento para os investidores a fazer os seus investimentos.

Em nenhum lugar a regra proposta sugere que a política será retroativa, o que significa que se os investidores são capazes de enviar suas petições antes da política proposta está em vigor, o montante de investimento elegível será de $500,000 para investimentos em TEAs e $1,000,000 caso contrário.

Update of EB-5 PROGRAM scheduled for NOV-2018

Final Rule Announcement expected for November 2018

The US Government Management and Budget Office has published its Unified Agenda for Regulatory Actions and Deregulation, which contains up-to-date agendas for two proposed EB-5 regulations and a third party notice.
The regulation of the greatest concern is RIN: 1615-AC07, “Modernization of the EB-5 Immigrant Investor Program”.
This regulation has now moved to the finals and is expected to be published in November 2018, becoming effective shortly thereafter.

Meaning of the final rule of program modernization

If it is “final” in November, the proposed rule could take effect by the end of 2018. Petitions submitted before the effective date of the final rule should qualify under the current policy ($ 500,000 minimum investment), but since rule will enter into force, petitions will be subject to any changes in the EB-5 program.

Early changes to the program made by the final rule

The exact changes to the EB-5 Program made by this rule will not be known until its final version is published, but the rule, as drafted today, proposes the following preliminary changes:

(1) an increase in the minimum investment threshold: from $ 1,000,000 to $ 1,800,000 for investments in “common” areas and from $ 500,000 to $ 1,350,000 for investments in rural or low-employment areas (TEAs)
(2) a change in the designation authority of the TEA areas: individual states cease to be responsible to the Department of Homeland Security
(3) a refined definition of “TEA” to include metropolitan statistical areas, municipalities, cities, single census tracts and limited groups of census tracts with high unemployment rates.
(4) in certain circumstances, permission to investors with petitions I-526 approved to keep their priority dates when submitting new I-526 petitions.
(5) the ability of petitioners’ spouses and children to file petitions I-829, even though they are not mentioned in the original petition of the investor.

ACTIONS TO TAKE NOW

FOR PROJECT DONORS: Now is the time to assemble the project documentation, get the support of a regional from the center, and send the outstanding petitions before such potential changes take effect.

FOR INVESTORS: Since the minimum capital requirement should increase substantially, now is the time for investors to make their investments.

Nowhere does the proposed rule suggest that the policy will be retroactive, which means that if investors are able to send their petitions before the proposed policy is in effect, the amount of eligible investment will be $ 500,000 for investments in TEAs and $ 1,000,000 otherwise.
