Desde 1990 o Programa Eb-5 trouxe cerca de 35 bilhões de dólares aos Estados Unidos, sem nenhum custo ao contribuinte americano, e gerou incontáveis postos de trabalho. Hoje “amadurecido”, o programa está pendente de reformas estruturais desde 2015, em constante discussão no Congresso e no Senado americanos. Dentre os rumores, o que se sabe de mais concreto em termos de mudanças significativas é o aumento do valor mínimo de aplicação, a redefinição do que caracteriza as áreas de impacto econômico (TEAs), e o aumento da supervisão do governo em cima dos Centros Regionais, para garantir uso apropriado dos fundos. Dentre este cenário de incertezas, por que agora, Janeiro de 2019, seria um bom momento para aplicar ao visto e dar o “passo de fé”?

A vantagem crucial é simples: o valor mínimo de 500.000 dólares americanos em áreas TEA ainda não aumentou. O shutdown do governo americano “congelou” as aplicações e as regras do programa até o momento, mas é quase certo que será continuado, talvez direto até o último dia fiscal de 2019, como por fim ocorreu nos anos anteriores. Os valores em discussão para as aplicações futuras, uma vez aprovado o aumento, devem passar de 1.000.000 de dólares por aplicante. Um segundo ponto favorável é que o Brasil em 2019 ainda não atingiu a cota de green cards por país, em torno de 700 unidades/ano, e não sofre do fenômeno chamado retrogression. Em outras palavras, brazileiros aprovados no Eb-5 não devem, nos próximos dois anos pelo menos, entrar em uma segunda fila por país, como ocorre hoje com os chinses e viatnamitas, por exemplo. Para se ter uma ideia, estima-se que existam pouco mais de 1 mil petições brasileiras em análise/processo, contra 52 mil chineas. Desta forma, entre 20 a 26 meses após a aplicação eles deverão receber os seus tão desejados cartões verdinhos. Isto leva a um outro benefício interessante: os recursos aplicados pelos brasileiros tendem a ser devolvidos após 5 anos, pois a ausência de filas adicionais normalmente promove tempo suficiente para completar o cliclo imigratório sem atrasos (green card condicional por 2 anos, e depois o processo chamado “remoção da condição”).

Outra vantagem é o momento cambial favorável: o dólar na casa de R$3,70 já precifica o otimismo dos investidores internacionais frente ao governo Bolsonaro de forma positiva para quem precisa aplicar em Eb-5, e aguardar um câmbio ainda melhor pode gerar em perdas muito maiores (como o aumento do valor do programa em si). Além disso, a diminuição do fluxo dos chineses (devido as tais filas adicionasi) fez com que haja grande variedade de projetos disponíveis, ainda não preenchidos, para escolha pelo aplicante brasileiro.

Ao aplicar no Eb-5 agora o eventual imigrante brasileiro garante as melhores condições financeiras, cria a sonhada reserva de capital em dólar e pode se organizar/preparar os seus ativos no Brasil (em um cenário de pré-retomada da economia) para evitar impostos em excesso, em ambos os países. O momento de dar o passo é agora, antes que este passo “dobre” de valor… em dólar!
